Land Use Planning

Ontario Land Tribunal (OLT)

With over a decade of experience and hundreds of appearances before the Ontario Land Tribunal (and its predecessors, the Ontario Municipal Board and Local Planning Appeal Tribunal), Ian Flett brings deep familiarity with the land use appeal process in Ontario. Whether you're advancing an appeal or responding to one, he provides grounded, strategic advice and effective representation tailored to your position—be it as a municipality, private landowner, or community group.

Ian’s approach is rooted in clear communication, thoughtful preparation, and a steady understanding of how planning law and local policy intersect in front of the Tribunal.

Municipalities

Ian Flett is proud to support Ontario’s municipalities with responsive, principled legal representation before the Ontario Land Tribunal (OLT). We work with small and mid-sized municipalities that may not have in-house planning law capacity, assisting with appeals related to minor variances, severances, subdivisions, and planning instruments such as official plans and zoning bylaws.

To help address fiscal and resourcing constraints, we offer flexible retainer structures designed to ensure predictable budgeting and consistent access to legal counsel for municipal staff and councils. Our approach reflects the unique realities of municipal governance and aims to support proactive participation in OLT processes without sacrificing cost control or service quality.

We welcome inquiries from CAOs, planning staff, or Town Solicitors exploring options for legal support in this area.

Ontario Superior Court of Justice

Tribunal decisions don’t always get it right. When there’s a clear error in law or process, seeking leave to appeal may be the necessary next step. With a strong foundation in administrative law and years of experience navigating appeals, Ian Flett can help assess whether an appeal is warranted and guide you through the process with clarity and focus. His approach emphasizes practical advice, careful legal analysis, and a commitment to ensuring that decisions affecting your rights meet the standards of fairness and legality.

Toronto Local Appeal Body (TLAB)

Appeals to the Toronto Local Appeal Body (TLAB) often turn on the reasoning found in the Committee of Adjustment’s decision. That decision can offer early clues about how the case may unfold—and whether an appeal is likely to succeed. Engaging a lawyer and planner early in the process can help set the right foundation. Ian Flett has represented both applicants and respondents at the TLAB and brings experience navigating the nuances of municipal decision-making and land use appeals.
